LAW 343 - Legal Issues on International Sale of Goods 1
This course discusses the most important legal issues on international sale of goods. The focus is on the United Nations Convention on Contracts for the International Sale of Goods (Vienna, 1980) (CISG), to which there are 89 contracting states including China, NZ and US. Case judgements in these jurisdictions are included in this course. Principal topics are: application and Interpretation of the CISG Convention; formation, and performance of contracts for international sale of goods under the CISG as compared to the most commonly adopted Incoterms such as FOB and CIF; termination of contracts and remedies. Relevant issues such as jurisdiction and governing law choices, passing of property and risks, export/import license and impossibility may also be discussed. Limited to LL.M. students and visiting scholars only.
