LAW 581 - Trade Secrets

We will examine what is-and is not-a trade secret. We will learn how trade secrets are preserved, and sometimes lost. We will tackle the Uniform Trade Secrets Act, adopted by Virginia and nearly all states, as well as relevant federal law. We will explore remedies, civil and criminal, for trade secret misappropriation, and defenses commonly asserted. We will discuss issues and strategic concerns that arise when litigating trade secrets cases so that students feel better prepared the first time they advise a client about or take on such a case.
